Welcome to Qloud LTD. These Terms of Service ("Terms") govern your use of our applications and services. By downloading, installing, or using any of our apps, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using our applications (including but not limited to Sentry Clip Viewer, Sentry Recovery, Phonetiq, and Qorrect), you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use our applications.

2. Description of Services

Qloud LTD provides mobile and desktop applications designed to enhance your productivity:

  • Sentry Clip Viewer: An application for viewing Tesla dashcam footage with telemetry overlays
  • Sentry Recovery: A macOS and Windows application for recovering deleted Tesla dashcam videos from USB drives
  • Phonetiq: An application for managing phonetic names in your contacts
  • Qorrect: An application for formatting contacts with international country codes

3. User Responsibilities

You agree to:

  • Use our applications only for lawful purposes
  • Not attempt to reverse engineer, decompile, or disassemble our applications
  • Not use our applications to infringe on the rights of others
  • Ensure you have the right to access and use any content you process through our applications

4. Intellectual Property

All content, features, and functionality of our applications, including but not limited to text, graphics, logos, and software, are the exclusive property of Qloud LTD and are protected by international copyright, trademark, and other intellectual property laws.

5. Privacy

Your use of our applications is also governed by our Privacy Policy. Our applications are designed with privacy in mind, with data processing occurring locally on your device whenever possible.

6. Third-Party Services

Some of our applications may integrate with third-party services (such as Tesla, Tessie, TeslaScope, or TeslaMate for Sentry Clip Viewer). Your use of these third-party services is subject to their respective terms of service and privacy policies. Qloud LTD is not responsible for the availability, accuracy, or content of third-party services.

7. Subscriptions and Payments

Some of our applications offer subscription-based licensing:

  • Sentry Recovery: Offers a free trial (3 recoveries) and an annual subscription ($49.99/year) for unlimited use

All payments are processed securely by Stripe. By purchasing a subscription, you also agree to Stripe's Consumer Terms of Service.

Subscription fees are billed annually in advance. Your subscription will automatically renew unless cancelled before the renewal date. You can manage your subscription through the Stripe customer portal.

8. EU Right of Withdrawal

For customers in the European Union: Under EU consumer protection law, you normally have a 14-day right of withdrawal for online purchases.

However, by completing your purchase of our digital software, you expressly:

  • Request immediate access to the digital content/services
  • Acknowledge that the digital content will be delivered immediately upon purchase
  • Consent to waive your 14-day right of withdrawal as the digital content is delivered immediately

This is in accordance with Article 16(m) of the EU Consumer Rights Directive (2011/83/EU).

Despite waiving the statutory withdrawal right, you are still protected by our 30-day money-back guarantee (see below).

9. Refund Policy

We offer a 30-day money-back guarantee on all subscription purchases. If you are not satisfied with your purchase for any reason, you may request a full refund within 30 days of purchase by contacting us at [email protected].

To request a refund:

  • Email us at [email protected] with your purchase email address
  • Include "Refund Request" in the subject line
  • Refunds are typically processed within 5-10 business days

After 30 days, refunds are provided at our discretion and may be prorated based on usage.

10. Disclaimer of Warranties

Our applications are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our applications will be uninterrupted, error-free, or free of viruses or other harmful components.

For Sentry Clip Viewer specifically: The telemetry data displayed is derived from Tesla vehicle data and is provided for informational purposes only. We do not guarantee the accuracy of this data, and it should not be relied upon for legal or evidentiary purposes without proper verification.

11. Limitation of Liability

To the maximum extent permitted by law, Qloud LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use or inability to use our applications
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from our applications
  • Any bugs, viruses, or the like that may be transmitted through our applications

12. Indemnification

You agree to indemnify, defend, and hold harmless Qloud LTD and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of our applications or violation of these Terms.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the effective date. Your continued use of our applications after such changes constitutes your acceptance of the new Terms.

14. Termination

We may terminate or suspend your access to our applications immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
